The Form That Controls Your 401k, and It Isn't Your Will

Your will does not decide where your 401k, IRA, or life insurance money goes. A separate beneficiary designation on each account does, and if that field is left blank, the money goes through probate and can get taxed at an estate rate starting at 35% instead of as low as 12% in personal income tax.

Does My Will Control My 401k or IRA?

No. Retirement accounts, life insurance policies, and most bank accounts pay out based on their own beneficiary designation, not your will. If that designation is missing, the account has to go through probate as part of the estate, and estate tax rates start at 35%, compared to as low as 12% in personal income tax on a normal retirement distribution.

This happened to a client whose husband had listed beneficiaries on every account except one, which held about half a million dollars. That account went into the estate and got hit with the higher tax rate before she could access it.

The fix takes about 15 minutes. Log into every account that would pay out if something happened to you: 401k, IRA, life insurance through work, any policy bought outside of work, even bank accounts. Find the beneficiary section, read it, fix anything wrong, fill in anything blank, and add a backup name underneath.

There are three solid options, and the right one depends on what the money is for. A regular savings account is simple, but check the rate. The national average is around 0.38%, while online high-yield accounts are paying around 4.21%, about 11 times more interest on the same deposit.

A 529 plan can be opened by the grandparent, in the grandparent's own name, with no contribution limit, and it grows tax-free. It's no longer just for college either. It now covers trade licensing and credentialing, things like welding, HVAC, aviation mechanics, and cosmetology.

The new Trump Account gives $1,000 in free money from the government to any child born between 2025 and 2028 with a Social Security number. A parent has to file Form 4547 to claim it. Grandparents and others can contribute up to $5,000 a year combined, but the account converts to a traditional IRA at age 17, so withdrawals for anything other than retirement get taxed as ordinary income instead of tax-free like a 529.

Is It Too Late to Fix My Tax Withholding This Year?

Not yet, but the window is closing. Pull a recent pay stub, find the federal income tax line, multiply it by the number of paychecks left this year, add what's already been withheld, and compare that to what was owed last year. If the number looks short, a new withholding form can close the gap before January arrives and the paychecks run out. The IRS Tax Withholding Estimator at irs.gov can run the math with a pay stub and last year's return.

Every Medicare Advantage and drug plan sends this letter before September 30, and it decides coverage options for 2027. It's easy to mistake for junk mail, and the person who opens it is often an adult child helping a parent, not the person actually on the plan.
